Default No Guarantee clause
I'm trying to tighten up my proposal and contract and am wondering what the "no guarantee clause" would cover. This sounds like an important item to include! Unfortunately, as goofy as this sounds, I'm not sure what I'm NOT guaranteeing?! Can someone give me a hint?

Shiloh, I think that would depend specifically on the services you are providing. Say for instance you are providing web services you might have a clause in there to protect you from being sued if something should go wrong with their website. Say, something was wrong with a WordPress update that was not in your control and it crashed your clients site. Due to that crash they lost tons of sales. You don't want them to sue you for that. So you'd put something in there to protect yourself against that.

I think that's what you are referring to. So just review your services and figure out how things might go wrong and how to word it protect yourself against being sued. You should know though that just because it's in your contract doesn't necessarily mean you can't be sued. It really depends on the laws of the state that governs the contract, but I would still put it in.

To protect yourself further it is a good idea to be at least an LLC, and to have errors and omissions insurance.

Hi, Also, if you are doing anything in the medical industry, sign a HIPAA form from your client. This protects you from seeing their patients personal/medical information. (I do medical transcriptions and billing/coding). I have all my clients sign a waiver that nothing is guarenteed. (This word, "nothing" gives me freedom to such things going wrong and not to meet my deadlines such as; accidents, power outages, computer going caflooey, etc.)

I am an LLC, so I'll look into the errors and omissions insurance. Great advice!
