Default sub contractor liability issues
I had this posted in another forum with no replies:

If I have a signed contract with a client (signed under an LLC) and I sub out the job, does the sub contractor have any liability issues if the client sues?

Sorry, but I'm not seeing your name anywhere.

Unfortunately, I think the reason no one has answered your question is probably because it's better directed at an attorney. Without having any idea of what is in your contract with your clients or in your contracts with your subs or any idea of exactly what kind of liability you speak of, it's just not a question that can be easily answered.

I agree with Kate - what does your contract say about liability?
I would imagine that a standard subcontractor contract places you in the seat of responsibility though, being that the client hired *your* company.

If you aren't well-versed in the language in your own paperwork and contracts I'd really suggest meeting with someone who can spell it all out for you - it will empower you as a business owner.

I would agree that it depends on the contract and also what role the subcontractor had in the problem. Besides asking an attorney, if you have business insurance or your sub has - perhaps could also bounce off their hear (although be CAREFUL). Good luck
