Default Is a signed contract required for subs?
Here's another question that came up during a podcast. I'd like everyone's feedback to help subcontractors out. On the other side of things I'd be curious if sub require a contract before starting work for another VA?

If you have a story you'd like to share please do.

Even though you are a sub for another VA, that VA is a client. For the protection of both of you, a contract is a must. It defines what the project is, what the pay scale is, what the time frame is. Definitely get it in writing.

Definitely get a contract. I made that mistake once - not having a formal/written contract and the battle for when I was to get paid could have been avoided. A contract should have payment terms, non-compete, confidentiality, expectations, etc. And both parties should be aware and in agreement.

HELP!!! I wanted to start a new thread - but could not figure out how. I am SO FRUSTRATED!!

I am in a dilemma... I saw an RFP here and I believe it may have expired, but I contacted the potential client to see if they still could use a VA. They had advertised for per project $250 - that one was gone. They said they have 12 VAs but have on-going projects and can use more. He referred my information to his assistant.

She sent me a W-9 and NDA which I immediately signed and faxed back to them. They talked as though projects would be coming soon.

There was no mention re pmt - amt., method etc There was no information forthcoming. When asked, she told me thought per hour preferable. I sent an email with several alternative pmt types and asked re their contract or mine...

She emailed back to me that had not expected all this (I thought I was trying to make it easier...) they are too busy to go through all this and will get back to me when have time to review and sort it all out. She went on to say none of their VAs required contracts or deposits, and paid them 12 something an hour. I went down on my fee, waived deposit (after she finally told me they pay weekly)

GEESH -- did I totally screw up? Is it me? I got this RFP from here and I used guidelines I see on here... any feedback?

I don't think contracts are "Required" per say but they are great for both parties, whether a client or a contractor.
I think if someone gave you a contract in which they state your duties but also what they will offer you, is great.
That way, you have a written compromise for payment and guidelines.

A contract is required for subcontracting. As Pam said, the VA is the client and should be accountable as should be the subcontractor.

Without a contract, who is say the VA would pay on time, in full or at all? A contract stipulates everything the subcontractor requires in order to perform the work. Just because the subcontractor is subbing doesn't mean that the position is anything less than what the VA who is paying the subcontractor.

Subs are business owners and should treat the transaction with a VA the same that they would treat the relationship with any other client.

This is very interesting. I'm looking to sub contract with a friend who is also a VA and I wasn't sure if I should draw up a contract. After reading a lot of these posts, it looks like a contract would protect hers and my business interests, and also our friendship in the long term.

Worked with two clients projects without the contract Fortunately, I have been paid. For the next project, I will definitely have a sub contract.
