Default What exactly IS the difference?
In trying to write my contract, I would like to include everything on the one - rather than having an service agreement to sign, then a Confidentiality agreement, then Independent Contractor, etc., etc. In doing so, I hope my Contract won't be huge! However, I'm not exactly sure what the difference is between a "Confidentiality" agreement and a "Non-Disclosure" agreement. Are they not basically the same thing? Should I have two separate clauses in my agreement?

Hi Sharon,

I've seen contracts that have the Confidentiality and the Independent Contractor listed as clauses in the contract. I think that in the end it is personal preference.

On the other side, it may be you should have it both ways. Some clients feel more protected with a seperate Confidentiality agreement.

I use one client agreement that contains everything. In this agreement there is a section entitled Confidentiality and a sub-section titled Non-Disclosure. You may take a look at my agreement if you want. I have it both in PDF and in Word.
