I have a EIN number under my genealogy site name, it is an LLC - I have decided not to do genealogy research under my EIN number but start my VOA business and include that among my skills. My business will not be called the same name - is that going to be a problem for me? Am I correct in hearing that I will only file my tax information once a year? I do not have any employees and plan not to have anyone but myself. Thank you in advance for the feedback.

If you do not want to create a new LLC you can file for a name change with your Secretary of State, you will also have to notify the IRS of the name change.

You will only file your tax return once a year, but you may need to pay estimated tax quarterly on your earnings.

I did not file my EIN # with Kansas as yet - can I then file with Kansas my new business name and let the IRS know that I have change the name of my LLC? Thank you for your time on this issue.

Is the EIN on the LLC or for you as a sole-proprietor? If its for the LLC then you don't legally have an LLC if you have not registered it with the State and you should not have applied for an EIN.

With that said, what's done is done. You need to file the name you intend to use with your Secretary of State, then you need to notify the IRS of the name change.

I could be wrong, but it seemed to me that when I filed with the state to form my LLC, I had to submit Articles of Organization and Operating Agreement within the Operating Agreement I had to list the function (product or service) that my LLC was to provide. I'm sure this may vary considerably from state to state, however, if this does apply in your state you would also have to amend your Operating Agreement to list your updated services from geneology to VA or at least amend to include VA work.

As with anything, it is always best to seek advice from a tax preparer or attorney. I am neither.
