Default What is the correct process for filing a DBA?
Good morning ladies,

I am looking to apply for a DBA Ficticious name for my company. I understand that I have to post some sort of ad in the local paper before I can apply for this.

Can anyone tell me the specifics of what it should say or look like to be sufficient for the application process?

Hi Sarraya, the requirements vary from state to state. In Oregon where I live the ad is not required. In many states, the Secretary of State is where you would record your dba, they probably have some FAQs available if so.

Yes the criteria differs from state to state. Here is a list of requirements or links to let you know what you will need for your state.

Also, remember to file for an EIN with the IRS so that you do not have to give out your SSN when securing client work.

I've looked in to the name registration also. It is confusing. I can work under my name without registering. I can work as a "dba" but have to register--and my SOS site isn't clear enough for me. Any other Georgia "dba" out there that can shed some light for me?

What is it that you are not clear about that the GA gov't site doesn't provide?

Does the site have an FAQ? I'm in FL and all of the answers to DBA and name registration are answered on the site.

If it is the same as FL, then you can file a DBA for X dollars. That way you don't have to use your own name as your business name.

In Georgia you need to file a Trade Name Filing before using a dba. From what I gathered in a quick search you must do so through your county clerk. I would start by searching the county site for "Trade Name Filing" and then if you still have questions, call the county clerk. They are generally most helpful and will get you through the process.

I wasn't clear on the difference between filing a Trade Name and filing a dba. But am now gathering that they are the same. I'm still working on it, thanks for the help Lee and Janine.

Just as requirements vary from state-to-state...so seems does the use of Trade Name vs. DBA.

One thing I went through recently with a fellow board member was trying to get that person to realize that a Trade Name was not the same as a Trademark...so I just wanted to throw this hat in the ring on that - since I've had that same question before - and had to kinda wrap my head around that fact too.
