Default Question about working with client's logo
If a customer has a logo but wants you to create stationary, business cards and use to create website, do you ask for verification that they own it or tell them you wont use it, but will recreate them one with same general idea?

Hi Erika -

Will they be printing their materials themselves, or getting their cards, stationary, etc. professionly printed? For professional printing, you need to make sure that the logo (and your designs) are done in 300dpi.

If they are providing the logo you should be all set, as (and I'm no lawyer) I think the fault would not be on you if it isn't theirs. Some clients may be offended if you offer to recreate a logo, because they already paid for it once, if you know what I mean.

If it was me, I would just use it... and have in the past... without asking if they own it. In the end, if won't hurt to ask for verification that they own it, though.

I have a clause in my web design contract to cover my butt should problems arise. They might say that they own the rights, but who knows, so I have this clause in my contract to cover my bases.

In case there is anyone who designs websites and doesn't have a clause, here it is (pretty standard - from my attorney):

CLIENT REPRESENTATIONS. Client represents and warrants that the text, graphics, and photographs provided to Designer for the Site are owned or licensed by Client, and that Client is authorized to use and display such items in the manner contemplated by this Agreement. Client shall be solely responsible for the Site and materials on the Site and the validity of copyrights, trademarks and ownership claimed by Client. Client agrees to indemnify and hold Designer harmless from and against any claim, loss, damage, expense or liability (including attorney's fees and costs) that may result in whole or in part, from: i) any infringement or any claim of infringement of any trademark, copyright, trade secret, or negligence arising from any of the text, graphics, and photographs provided by Client, ii) any claim by a third party regarding any services or products sold or otherwise distributed by Client, its employees or agents, or iii) any claim, suit, penalty, tax or tariff arising from Client's use of the internet or electronic commerce.
